Terms and conditions

Scope

These terms apply to any visit to finexpert.be and to any contact you make with us through this website. They do not govern the content of an ongoing engagement: that is set out in the engagement letter or framework agreement you sign with us separately. Where this page and that agreement say something different, the signed agreement takes precedence.

Who we are

Finexpert BV, based at Plantin en Moretuslei 331B, 2140 Antwerpen, is registered with the Crossroads Bank for Enterprises under company number 1022.862.129 (VAT number BE 1022.862.129) and with the ITAA (Institute for Tax Advisors & Accountants) under number 53.441.845. We provide bookkeeping, tax and administrative services to businesses and the self-employed.

Our services

Our services include, depending on what we agree with you:

• Organizing and running the bookkeeping
• Preparing the annual accounts and assistance with company-law obligations
• VAT returns and personal or corporate income tax returns
• Representation before the tax administration
• Advice on setting up a business, financial planning and other business questions

How an engagement comes about

An actual collaboration only starts with a signed engagement letter or framework agreement. In it, we set out which tasks we carry out for you, how we charge for them and which arrangements apply specifically to your file. These terms and conditions do not replace that agreement, they complement it.

Your responsibility as a client

The quality of our services depends on the information you provide us. You make sure the documents and data you supply are timely, complete and correct. Work that is needed because that information was missing, arrived late or was incorrect can be charged as an additional service.

Our responsibility

We carry out our engagement as a skilled, careful professional, but never interfere in the management of your business. You remain solely responsible for your strategic choices and their consequences. Our liability is limited to the amount covered by our mandatory professional liability insurance, except in case of intent or gross negligence on our part. We are not liable for indirect damage, such as loss of income or lost profits.

Fees and invoicing

The fees for a specific engagement are agreed with you in advance in the engagement letter or framework agreement. Invoices are exclusive of VAT unless stated otherwise, and payable within the term shown on the invoice. In case of late payment, we may charge late-payment interest and a penalty clause as set out in our agreement.

Documents and retention

The records, books and documents you provide us remain your property. We keep them for as long as we need them to carry out our engagement, and you can inspect or request them at any time. After our collaboration ends, you are responsible for their further retention.

Confidentiality and privacy

We treat your data confidentially and in line with the professional secrecy we are bound by as an ITAA professional. You can read how we process personal data in our privacy policy.

Force majeure

If we cannot meet our obligations due to a circumstance beyond our control, such as a prolonged system or power outage, we are not liable for this. We will notify you as soon as this occurs and look for a solution together.

Complaints and disputes

Have a complaint about our services? Contact us directly first: that is how most issues are resolved fastest. If we cannot reach an agreement, you can turn to the ITAA's mediation service before a dispute is brought before the court.

Applicable law

These terms and any agreement with Finexpert are governed by Belgian law. Disputes that cannot be settled amicably fall under the jurisdiction of the courts of the judicial district of our registered office.

Changes

We may amend these terms and conditions, for example following a change in legislation or in how we operate. The version online at the time of your visit is the version that applies.
